B: What we are saying is this: the federal government must do this, if it feels that the hizbah authority is doing something wrong. It should take the hizbah authority or the Kano government before the court, saying that the hizbah law that we have violates the national law. God willing, we will then have a hearing and the judge will make a ruling. A: Aren’t you afraid of the disturbances that could follow from this, as if you are conceding [putting on one-legged pants] with the federal government? B: But this is democracy: there will be no disturbances, there’s no conceding. What we are saying is this: there’s a law. No one sat down and wrote this law. We took this to the legislature, our legislature here, in Kano, which our democratic dispensation has produced. Because of this, if they make a law, no one should sit in Abuja and say he’ll abolish it. A: Is there a possibility that the federal government might rely on some law that is in the bowels of the constitution, that would give it the authority to take this step to abolish this hizbah authority? B: No, it’s not possible. You see, even if the ... federal government had some law that they thought exceeded the strength of our law, there’s no one who could take on the dispute except for a court judge. According to the democratic system, when the constitution is followed, the law is made. If one thinks there is a mistake in this law, or someone thinks there is a lack of truth in it, you can’t come out of it on your own and say you’ll abolish it; you can only go to court, or else return again to the legislative route. A: As the hizbah authority prohibits young men from picking up women on their scooters, when the activity of this authority became public, didn’t you feel the way the hizbah officials were running their activities was the reason people kept complaining? B: Well, this complaining there will always be complaining; it’s better to stop and see who’s doing the complaining. I am certain that you can go about and find young men with scooters for hire who are good Muslims, who are reputable and who know the etiquette of their reputation and the reputation of their religion and the reputation of their women. They are not the ones who are in an uproar over this law. It’s a small number of people who benefit from them, and it’s beginning to have the appearance of politics because of vulgarity and ignorance. Perhaps one thinks that if one challenges this law as government politics, one is challenging it. This is a mistake. And for us what matters is, we will follow these laws on the condition of certainty that no one is betrayed, but the usefulness of the law is that whoever breaks it will be judged. A: What is the status of the hizbah commander and his assistant who are in police custody? B: Well, this … we got the news that they are in police custody, and we are following their disposition, ah, and we’ll continue to follow their disposition, about which I spoke to some of the security officials, and about which I will also go myself, God willing, ah, after this conversation, to find out the basis under which they were detained. Because this hizbah activity that they’ve been doing, it’s not for themselves that they’re doing it; meaning, it’s the government that established the hizbah authority, it’s the government that made the law; we’re the ones who called them and requested them to come and help us carry out this activity. It is we who should say what kind of work they were doing, not for them to be arrested and interrogated; we who gave them work should be informed about the basis and reason for the interrogation … A: That was the Governor of Kano State, Mallam Ibrahim Shekarau. Kano is Northern Nigeria's commercial center and history describes it as a site of religious and political violence. Religion is very important to most Nigerians and religous life is public and diverse. However, the country continuously suffers violent conflict in the communities along ethnic and religious lines. Many northern states are attempting to implement the religious law known as the Shari'a law, a law which finds its roots in the Muslim's holy book known as the Koran. This has been a continuous source of division, tension and crisis between the two major religious groups in Nigeria-Muslims and Christians. People define Hizbah differently but it is more or less another way of introducing the Shari'a law in some Northern Nigerian states. Some describe Hizbah as religious enforcers or religious police in charge of enforcing the Shari'a law. Hizbah is mostly made up of young people who are believed to have little or no formal education, enjoying authority by imposing their views of morality. In most cases non-Muslims living in the states where these laws are practiced are affected because this law generally has no regard for their religion even though it claims to exempt them. Women are also the targets in most of these laws and they are given little or no room to defend themselves.
