State of Emergency A: So, Mallam Taminu, in your position as a lawyer, what would you say regarding this matter that took place in Ekiti State, that is, the state of emergency that President Olusegun Obasanjo has established? B: Well, Halima, legally speaking … what President Obasanjo did was right, to place Ekiti State under a state of emergency, and it was constitutional. Because … what was happening in Ekiti State is this: they wanted to place the state in a helpless situation. A difficult situation, because look at the men who were elected to the position of Governor and Deputy Governor, by the letter of the law. Someone came and said that they were being charged, that they were suspected of illegal activities. The Constitution already laid out step-by-step the method for verifying this accusation, and it is that one investigates such an accusation against them before undertaking a judgment against them. None of these things was done. Secondly, it is the Chief Judge of Ekiti State, Justice Bamusule, to whom the Constitution gives the responsibility for appointing the committee that would investigate any accusations that the Legislature might have. As … far as he thought, he chose the people that he felt had the reputation that they would stay and do this investigation. But the legislators said they didn’t agree to them. By law and custom, what they were required to do was to write a note telling the Chief Judge of Ekiti State that “some of the people you put on this committee are people whose faith and sincerity the public would not be able to agree on.” And for various reasons, they did not do this. Secondly [sic], they have the right to go before this committee and say, “Although we came before you in your position as the committee that the Chief Judge has appointed to investigate these accusations that we have regarding the Governor and … his Deputy, we don’t have the means for this and this and this, and our reason is such-and-such. Because of this, we want you people whose standing to do this work we are skeptical about, we want you to get out of this assignment, to pass judgment on yourselves, to understand {---} of yours in this thing.” This is quite normal. Often a lawyer or barrister would come before the judge and say, “Judge, I have a case before you that I am appealing, or someone has a case against me, but I don’t think you could judge it on account of such-and-such.” Under this circumstance, the judge would say, “Alright, I agree even though I don’t understand those reasons of yours. I will excuse myself from this case and forward it to another judge whom everyone will trust to be fair.” They didn’t do this. Instead, the speaker of the Ekiti State legislature got up and went to the court, the High Court of Ekiti State, where the Chief Judge who … was dismissed. He put the committee under oath, and told them to suspend what they were doing, because we don’t agree with this, etc., etc. Well, the course that they took, it wasn’t right. They didn’t follow the letter of the law, they didn’t follow the … ah … Constitution. A: Mmm … B: So, after this, they said they would go and suspend them from the work they were doing. After they said they would suspend them, they said they would appoint another judge as a replacement … who would continue running things previously run by the panel that the Chief Justice had appointed. Well, the Constitution of Nigeria came out with the regulation that you would follow to dismiss a judge, or to place an appointment before placing one who would inherit it. They didn’t follow this regulation. And from this I am confirming to you that, from that day, everything the Ekiti State legislature did has been stupid, ignorant, illegal and unconstitutional. And they had to understand that they were legally and constitutionally in a position to do things right. But you cannot wake up in the morning and suddenly decide to remove someone without a basis. You said you’ve already gone too far since you made the decision so long ago to dismiss this person that you were accusing. And then you’ll judge yourselves and expect that people will agree and say the judgment you meted out to yourselves was fair. After this, if someone looks at everything that was happening, no one knows where the Governor is, and the Deputy Governor Chief Mrs. Olujini said that she is, until now, or as of yesterday, that she is the Deputy Governor of Ekiti State. As for Speaker Adele, he has come to say that he is an interim Governor. So we find ourselves in a situation where if the President does not benefit from the opportunity that the Nigerian Constitution gives him, it will come to a confrontation, it will come to a slip of the tongue, it will put the people of Ekiti State in circumstances in which unfortunate things could happen. A: So has this state of emergency that President Olusegun Obasanjo established brought stability, and is there nothing more that Mrs. Olujini, can do? B: It has brought stability, Halima, and she’s fine, and people are thanking her … and myself, in my position as a legal expert, I give thanks to President Obasanjo, for this urgent step that he took to bring a rescue operation to the people of Ekiti State, before things came to a complete collapse. Everything is fine, Halima. But what I’d like people to understand, Halima … is that … these things that happened, and the things that we thought would happen … Well, we need an independent judiciary, and we need peace in the capital of Ekiti State, so that people see for themselves that no one will be favored in the administration of the law, no one will be given more of an opportunity than anyone else, on the basis of these things that have been done.
